Korea Cosmetics Responsible Seller: Registration Explained

In Korea, any company that places cosmetics on the market under its own responsibility must register as a cosmetics responsible seller (화장품책임판매업) with the Ministry of Food and Drug Safety (MFDS).
That covers brands that manufacture in-house, brands that outsource production to an OEM or ODM, and importers. The registration names a qualified responsible manager who looks after quality control and post-market safety.
For overseas buyers, the responsible seller is the company printed on a Korean label as the party liable for the product. Knowing who it is helps when you need safety data, ingredient lists or documents for registrations in your own country.
Step 1: Work out whether the business needs a responsible seller registration
The Cosmetics Act1 splits the industry into three types of business: cosmetics manufacturing, responsible cosmetics distribution (the responsible seller), and customized cosmetics sales. A responsible seller distributes or sells cosmetics while managing their quality and safety, and the category also covers import agency transactions. In practice it includes:
- A company selling cosmetics it manufactures itself.
- A brand selling products made for it by a contract manufacturer.
- An importer selling foreign cosmetics in Korea.
- E-commerce businesses running import agency transactions.
Article 3 of the Cosmetics Act2 requires these businesses to register. A trading company that buys finished products already released by another responsible seller and exports them usually sits outside this role, because a responsible seller for those products already exists.
Borderline cases, such as an export-only private label, should be confirmed with the regional MFDS office. Our OEM vs ODM comparison explains the contract-manufacturing side.
Step 2: Appoint a qualified responsible manager
Article 8 of the Enforcement Rule3 sets who can act as the responsible manager:
- A medical doctor or pharmacist.
- A bachelor’s degree holder in science or engineering, or in cosmetic science, Korean medicine, herbal pharmacy, nursing and similar fields.
- A holder of an associate degree in a cosmetics-related field such as chemistry, biology or chemical engineering, with at least one year in cosmetics manufacturing or quality control.
- Someone who passed the customized cosmetics preparation manager exam, or completed an MFDS-designated course for specified product types.
- Anyone else with at least two years in cosmetics manufacturing or quality control.
If the business has ten or fewer regular employees and the owner (or the representative of a corporation) meets one of these criteria, that person can perform the duties and the business is treated as having a manager.
Step 3: Prepare the quality and safety standards
Under Article 4 of the Enforcement Rule4, the application attaches two things: the company’s rules on quality control and post-market safety management, and proof of the responsible manager’s qualifications. These rules cover how the seller supervises its manufacturer, keeps test records and releases batches, and how it collects and reports adverse events.
Step 4: File with the regional MFDS office
The application goes to the regional office of the MFDS that covers the location of the business in Korea, and it can be filed electronically.
Because registration is tied to a business location in Korea, a foreign brand normally sells through a Korean company that holds the registration and acts as its importer. Changes to key details, such as the trade name, address or responsible manager, must also be registered.
Step 5: Keep up with the duties after registration
Article 5 of the Cosmetics Act5 requires a responsible seller to:
- Follow its quality control and post-market safety standards, including quality testing.
- Report safety and efficacy information.
- Report production or import figures every year, and report the ingredient list for each product before it is distributed.
- Make sure the responsible manager completes annual training on cosmetics safety and quality.
The responsible seller’s name and address go on the package, and rules such as Korea’s ban on animal-tested cosmetics are enforced against it; see our Korea animal testing ban guide.
Why this matters to overseas buyers
When your regulator asks for a product information file, an ingredient list with INCI names, or confirmation of animal testing status, the Korean responsible seller is the company that holds the original records. A good supplier can tell you who that company is for each product and help request documents. For INCI conversion, see INCI names for Korean ingredients.
